Guaran tee and Compensation

Barco provides a gua rantee relating to perfect man ufacturing as part of the legally stipulated terms of guarantee . On receipt, th e pu rc haser

mu st immediately inspect all delivered goo ds for damage incur red during transport, as well as for m aterial and m anufacturing faults Bar c o

must be informed immediately in writing of any c omplaints.

The perio d of guara ntee begins on the date of transfer of risks, in the c ase of sp ecial s ystems and software on the date of c omm issioning,

at latest 30 days after the transfer of risks. In the event of justiﬁed notice of com plaint, Barco can r epair th e fault or p rovide a replacement

at its own disc retion within an appropriate period. If this measure proves to be impossible or unsuccessful, the purchaser can demand a

reduction in the purchase price or cancellation of the contract. All other claims, in particular those relating to compensation for direct or

indirect damage, and also damage attr ibuted to the operation of s oftware as we ll as to other services provided by Barco, being a component

of the sys tem or independe nt service, will be deemed invalid provid ed the dam age is n ot pro ven to be attributed t o the abs ence of properties

guaran teed in writing or due to the intent or gross negligence or p art of Barco.

If the purchaser or a third party carries out modiﬁcations or rep airs o n go od s deliv ered by Ba rco, or if the goods are handled incorrect ly,

in particul ar if the systems are oper ated inco rrectly or if, after the t ransfer of risks, the go od s are s ub ject to inﬂuenc es not agreed upon in

the contract, all guar antee claims of the purchaser will be rendered in valid. Not included in the guarantee coverage are sy stem failures

which are attributed to programs or special ele ctronic circuitry provided by the purchaser, e.g. interfaces. Nor mal wear as w ell a s normal

ma intenance are not subject to the guarantee p rovided by Barco either.

The en vironmental co nditions as well as the servicing and m ain tenance reg ulations speciﬁed in this manual must be complied w ith by the

customer.
